Terms & Conditions
Version 2026-10-20 · Effective October 20, 2026
Template prepared for Higher Ground Media on October 19, 2026 and updated October 20, 2026 (new section 4: crashes, damage and obstacles). It has not been reviewed by a lawyer; have one check it before the app is offered to the public.
These Terms are an agreement between you and Trying to Help Inc., doing business as Higher Ground Media ("Higher Ground Media", "we", "us"), the maker of the Shot Planner app and website (the "App"). By creating an account or using the App you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the App.
In plain English: Shot Planner only helps you plan. You are the pilot. If your drone crashes, hits a tree, a wire or a building, gets lost or damaged, hurts someone, or you get a fine, that is your responsibility, not Higher Ground Media's, even if you were following a plan, route, spot or mission file from the App. Always check the area, the airspace, the rules and the weather yourself, and review every mission before you fly it.
1. What the App is
Shot Planner helps drone pilots plan photo and video shoots. It shows sun and light times, weather, airspace and drone-rule information, suggested spots, shot lists, permit-request templates and waypoint-mission files. It is a planning aid only. It does not fly your drone, does not authorize any flight, and does not replace your own judgment, training or official sources.
2. You are the pilot in command
You alone are responsible for every flight you make, including whether, where, when and how you fly. Before each flight you must check official sources yourself and follow all laws and rules that apply to you, including:
- FAA rules (14 CFR Part 107 for commercial flights, or the rules for recreational flyers under 49 U.S.C. § 44809, including the TRUST certificate), Remote ID, registration and night-flight rules;
- airspace authorizations (LAANC or FAA DroneZone), temporary flight restrictions (TFRs) and NOTAMs;
- park, land-manager and property-owner rules, permits and permissions, and laws on trespass, privacy, harassment, noise and local ordinances.
3. Information may be wrong or out of date
Airspace, TFR, weather, light, terrain, spot, "drone rule", permit and land-ownership information in the App comes from public data sources and our own summaries. It can be incomplete, delayed, wrong or out of date, and rules change without notice. A spot or launch point shown in the App is not a statement that flying there is legal, safe or permitted. "Check", "ask the owner" and similar labels mean you must find out yourself. Waypoint missions are generated automatically and may contain errors: preview every mission in your flight app, check heights and obstacles, and be ready to take manual control.
4. Crashes, damage and obstacles are your responsibility
The App can't see the real world. It does not know about every tree, branch, power line, wire, pole, tower, building, crane, bird, person, vehicle, change in ground height or other obstacle, and the data it uses can be missing or wrong. Plans, routes, flight paths, heights, takeoff points, suggested spots and exported waypoint missions (for example DJI .kmz files) are suggestions only.
Before and during every flight you alone are responsible for:
- walking or checking the area and the whole flight path for obstacles (trees, wires, buildings and anything else), and choosing safe heights and distances;
- checking the airspace and following the law, including FAA Part 107 or the recreational flyer rules, LAANC or other authorizations, TFRs, Remote ID and local rules;
- checking the weather, wind and light, your battery, signal and return-to-home settings;
- knowing that your drone's own obstacle sensors may not work (for example in low light, near thin wires or branches, during waypoint missions, or when the drone turns them off) and not relying on them;
- opening and reviewing every exported mission in your flight app before flying it, keeping the drone in sight, and being ready to take manual control or stop the mission at any time.
Higher Ground Media is not responsible for any crash, collision, flyaway, loss or damage to your drone, controller, camera or other equipment, any damage to other people's property, any injury or death, or any fine, penalty, claim or legal problem that comes from using the App or any plan, route, spot, information or mission file from it, including when you followed the App's suggestions. You agree not to bring any claim against Higher Ground Media for these things, to the fullest extent the law allows.
5. Assumption of risk
Flying a drone involves risks, including injury, death, damage to property, loss of the aircraft, fines and legal action. You use the App and fly at your own risk, and you accept those risks.
6. No warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We don't promise the App will be uninterrupted, error-free, secure or that any information in it is accurate.
7. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, HIGHER GROUND MEDIA AND ITS OWNERS, OFFICERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOSS OR DAMAGE OF EQUIPMENT, FINES, PENALTIES, LOST PROFITS, LOST DATA OR LOST BUSINESS, ARISING FROM OR RELATED TO THE APP, ITS INFORMATION, OR ANY FLIGHT, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR US $50. Some places don't allow some of these limits; there, they apply to the fullest extent allowed.
8. Indemnity
You agree to defend, indemnify and hold harmless Higher Ground Media and its owners, officers and employees from any claims, damages, losses, fines and costs (including reasonable attorneys' fees) arising from your flights, your use of the App, your content, or your breaking these Terms or any law.
9. Your account
You must be at least 13 years old to create an account (FAA rules set their own age limits for pilots). Give a real email address, keep your password, recovery code and backup codes secret, and tell us if you think someone else got into your account. You're responsible for activity on your account. You can delete your account at any time in the App (Settings › Account & security › Delete my account).
10. Acceptable use
Don't misuse the App: no breaking the law, no attacking or overloading the service or the public data services it uses, no scraping, no reverse-engineering beyond what the law allows, no reselling, and no using it to plan flights meant to harass, spy on or endanger people.
11. Your content
Plans, notes, permit records and settings you save stay yours. You give us permission to store and process them only to run the App for you, as described in the Privacy Policy.
12. Third-party services and trademarks
The App uses and links to third-party data and services (see Credits & licenses). We don't control them and aren't responsible for them. 13. Ending access
We may suspend or close accounts that break these Terms or put the service or others at risk, and we may change or stop the App at any time. Sections 3 to 8 and 14 survive after your account ends.
14. Governing law
